Auction Listing Agreement - Exclusive Right To Sell For
Consigner herein referred to as client

Agent will create one individual internet auction listing This service includes up to 5 digital photographs per item or set, composing ad copy, obtaining a professional appraisal to determine current market value if requested, and managing the entire auction from start to finish which includes collection of payment from the buyer.
Shipping: The item(s) for sale will remain in the possession of Agent, who is responsible for keeping the product(s) in good saleable condition. Agent will find the most cost-effective shipment method (or method requested by buyer), supply packing and shipping materials, and will ship auction item to winning bidder -- handling all phases of the entire auction.
Agent's commission PER AUCTION will be set % of the winning bid / buyer purchase price as indicated on fee schedule on front of this form. This includes fees imposed by auction site/s (listing and final value). All prepaid fees are non-refundable regardless of whether or not the item sells. Agent will submit payment to Client (minus commission fees see fee schedule below ) after the auction buyer has received the item and their 15-day warranty period expires. A detailed receipt of all charges will be provided to Client.
Per client request, to determine fair market value of the item(s) being auctioned, an independent appraisal from a professional company can be obtained by using Agent's service. This is to assure that the Client will get the best possible price for the merchandise. Agent will handle all the details of this process and a fee of $35 will be collected per appraisal. This fee is due and payable at the signing of this Agreement. Said appraisal is merely an estimated pricing guide and not a guarantee that the item will sell for its appraised value.
By entering into this Agreement, Client hereby agrees to grant Agent the sole and exclusive right to sell said merchandise on auctions or any other venue for the designated period indicated on front of this form. During that time, if Client attempts to sell the item(s) himself AND there are no bids on the item, the Agreement for that item can be canceled but Client will still be responsible to pay the Agent the commission fee (as described above) within 3 days of the outside sale. Agent must be immediately notified so the auction can be aborted.
Non-paying buyers will be dealt with through the proper ebay proceeders to obtain refund of final value fees (Note: per ebay listing policy listing fees will be credited on re-listings of previous un-paid listings that sell the second time).
The commission fees Do include the ebay Final Value fees and all Paypal fees, but DO NOT include shipping, packaging and insurance fees (always paid by the buyer). Sales tax may be charged where applicable. All items not sold and not picked-up within 15 days will be donated to charity. A cleaning service is also available for dirty items, charges will apply! All items to be sold on ebay Motors are to be addressed individually.
Large items may incur an additional charge. Pick-up service available for large items, quantity or special circumstances!
